Seguro con fecha de Julio(2) / Insurance finishes in July(2)

La normativa vigente cuando se construyó el resort era la Ley 38 de 1999 (Ley de Ordenación de la Edificación). Su artículo 6 habla de la recepción de la obra, donde referencia la fecha de garantía al acta de fin de obra; también dice que, si no se pacta lo contrario, el tiempo transcurrido entre el certificado final de obra y el acta de recepción debe ser inferior a treinta días. El seguro decenal era obligatorio, pero no el trienal. Por tanto, tenemos:
  • Certificado final de la dirección de obra (3 julio 2007)
  • Acta de entrega del libro del edificio, la mayoría sin cumplimentar bien (31 julio 2007)
  • Póliza de seguro decenal (3 julio 2007)
  • Acta de fin de obra, ante notario (26 de septiembre 2007)
Oficialmente, si no ha habido cambios posteriores, la garantía trienal expira en septiembre de 2010, y la decenal en septiembre de 2017, acabando la póliza 2 meses antes.

En resumen, la garantía es independiente al seguro. Las humedades no están cubiertas por el seguro, aunque sí garantizadas hasta septiembre. Si el responsable de estos defectos perdiera el juicio tendría que pagar las indemnizaciones de su bolsillo.

Las supuestas irregularidades acerca del tiempo transcurrido entre el certificado final de obra y el acta de recepción, y sobre los 2 meses de garantía no cubiertos por el seguro decenal son responsabilidad de Polaris. ¿Alguien tiene más información sobre este tema?

Nuestro Administrador de Fincas bien podría haber explicado esto hace un tiempo para la tranquilidad de los vecinos.


When our resort was built, spanish law "Ley 38 de 1999" was in force. (Law about building). Its 6th article talks about "resort working reception" (sorry about english translations, they are legal documents), where warranty's date is related to "end working minutes"; it also says that, if an agreement isn´t reached, time delayed between both documents must not exceed 1 month. Insurance policy for ten years was mandatory, but three years' one wasn´t. Therefore, we have:
  • End working certificate (3 July 2007)
  • Uncomplete "Building´s Book" (31 July 2007)
  • Insurance policy for ten years (3 July 2007)
  • End working minutes, by notary (26 de septiembre 2007)
If there weren´t changes after that, three years warranty will expire in September of actual year (2010), and ten years' one in September 2017, but insurance policy will finish 2 months before (July 2017).

Summarizing, warranty is independent of insurance. Damps aren´t covered by insurance, but they should be guaranted; that means that if responsibles of defects lose trial, they should pay compensations with their own money, and we have time enough for technical report.

If other things have been done incorrectly (time between legal documents, and 2 months uncoverd by mandatory insurance policy), Polaris look like responsible. Could anybody offer more information about it?

At last, legal department of our Resort Administrator could have explained this time before, in order to avoid concerns in neighbours.
