Real Decreto sobre Autoconsumo / Royal Decree about Energy Self Consumption

In the post Royal Decree of Net Metering we discussed a Royal Decree draft issued by the former Government in November 2011. It spoke about regulating and promoting the generation and consumption of electricity from renewable sources by individuals, communities and businesses. From an economic and ecological standpoint it seemed a reasonable proposal.

What happened in these two years?

On July 18, 2013, the Government sent to the Energy National Commission (CNE) the so-called Second Draft about Energy Self-Consumption and Net Metering to carry out the required report that the Law marks.

CNE’s report was highly critical. Brussels also gave a negative assessment, as well as several regions (Murcia included) and the whole renewable energy sector.

Nevertheless, on September 20, 2013 the Council of Ministers approved to develop the Draft of the New Electricity Industry Act, according to the content of the quoted Second Draft.

Why a New Electricity Industry Act?

Electricity rates in Spain are partially regulated. A complex system of subsidies, the nuclear moratorium and other items have impact in them.

To prevent a too high electricity price being paid by consumers and businesses, since at least 2000, the rates fixed by the successive governments and applied to users do not cover the production costs of this energy.

This generates the so-called tariff deficit, which at some point and in some way we will have to pay to the utilities (even if they have to accept an amount reduction).

The accumulated tariff deficit reached 28,000 million € by the end of 2012 (around 2.8% of Spanish GDP). This situation is impossible to maintain.

Why criticize the new draft?

The main reason (there being many others) is a new tax called backup toll that is imposed to generators of renewable energy by the fact of generating the energy, even in the case it is never injected into the grid.

To start with, this backup toll is 27% higher than the electrical network access toll for a conventional domestic installation.

Forbes magazine described this toll as a tax to the sun, which discourages completely new solar installations.

For many, mainly in the photovoltaic sector, the rules that the government intends to become law are a capitulation to the interests of the five major Spanish electricity companies (Endesa , Iberdrola , Gas Natural Fenosa, Spain and HC E.ON Energy). Self-generation of photovoltaic solar energy was beyond their control (what does not happen with wind farms) and threatened to harm their business.

What happens in other countries?

The situation in Spain, as complicated as it may seem, is not exclusively ours. Other countries like Germany and USA (especially Arizona), where large investments in photovoltaic were made, share concerns, and are waiting to see what happens here, as Forbes explained also.

What will happen in Spain?

Energy is the beginning of everything. An economy cannot work well if the energy it needs is more expensive than for its competitors. This occurs when we rely on imported oil and gas, much of which is used to generate electricity.

The necessary restructuring of the electricity market is a subject of great complexity due to the number of variables involved and competing interests. Moreover, if changes threaten the profitability of many investments and the business model of large companies, the trouble is apparent.

What we will not be able to avoid are new electricity tariff increases, particularly on the fixed term of the bill, not linked to the amount of energy consumed.

En la entrada Real Decreto de Balance Neto comentamos un borrador de Real Decreto publicado por el anterior Gobierno en noviembre de 2011. Hablaba de regular y favorecer la generación y autoconsumo de energía eléctrica de origen renovable por particulares, comunidades y empresas. Desde un punto de vista económico y ecológico, parecía una propuesta razonable.

¿Qué ha pasado en estos dos años?

El 18 de julio de 2013, el Gobierno envió a la Comisión Nacional de la Energía (CNE) el denominado Segundo Borrador sobre Autoconsumo y Balance Neto para la realización del preceptivo informe que marca la Ley.

El informe de la CNE fue muy crítico con este borrador. También Bruselas hizo una valoración negativa, así como varias comunidades autónomas (Murcia incluida) y todo el sector de las energías renovables.

Pese a ello, el 20 de septiembre de 2013 el Consejo de Ministros aprobó la tramitación del Anteproyecto de la Nueva Ley del Sector Eléctrico,  de acuerdo a lo recogido en el citado Segundo Borrador.

¿Por qué una Nueva Ley del Sector Eléctrico?

Las tarifas eléctricas en España están parcialmente reguladas. En ellas se repercute un complejo sistema de subvenciones, la moratoria nuclear y otros conceptos.

Para no encarecer en exceso el coste de la energía eléctrica a consumidores y empresas, desde al menos el año 2000, las tarifas establecidas por los sucesivos gobiernos y aplicadas a los usuarios no cubren los costes de producción de dicha energía.

Esto genera el denominado déficit de tarifa, que en algún momento y de alguna forma habrá que pagar a las compañías eléctricas (aunque tengan que asumir una quita).

El déficit de tarifa acumulado alcanzaba los 28.000 millones de € al final de 2012 (alrededor de un 2,8% del PIB español). Una situación imposible de mantener.

¿Por qué se critica el nuevo borrador?

La razón principal (ente otras muchas) es que impone a los generadores de energías renovables un impuesto llamado peaje de respaldo por el mero hecho de generar dicha energía, aunque nunca se inyecte en la red eléctrica.

Este peaje es en principio un 27% mayor que el de acceso a la red eléctrica de una instalación doméstica convencional. El borrador se carga así de facto el autoconsumo.

La revista Forbes calificaba el peaje de respaldo como un impuesto al sol, que desincentiva por completo nuevas instalaciones de placas solares.

Para muchos, sobre todo del sector fotovoltaico, la normativa que el gobierno pretende convertir en ley, es una claudicación ante los intereses de las cinco grandes compañías eléctricas españolas (Endesa, Iberdrola, Gas Natural Fenosa, E.ON España y HC Energía). La autogeneración de energía solar fotovoltaica se escapaba a su control (cosa que no ocurre con los parques eólicos) y amenazaba con perjudicar su negocio.

¿Qué pasa en otros países?

La situación en España, por complicada que pueda parecer, no es exclusivamente nuestra. Otros países como Alemania y USA (en especial Arizona), en donde se han hecho grandes inversiones en energía fotovoltaica, comparten preocupaciones  y están a la expectativa de lo que ocurra aquí, según explicaba también Forbes.

¿Qué va a pasar en España?

La energía es el principio de todo. Una economía no puede funcionar bien si la energía que necesita es más cara que la de sus competidores. Esto ocurre cuando se depende de petróleo y gas importados, buena parte de los cuáles se usan para generar electricidad.

La necesaria reordenación del mercado eléctrico es un tema de gran complejidad por la cantidad de variables que intervienen y de intereses enfrentados. Si además los cambios ponen en riesgo la rentabilidad de muchas inversiones y el modelo de negocio de grandes compañías, el conflicto está servido.

De lo que no nos salvaremos es de más subidas en la tarifa eléctrica, en especial del término fijo de la factura, no ligado a la cantidad de energía consumida.

La historia de Hacienda Riquelme en Google Earth / The history of Hacienda Riquelme in Google Earth

In the posts The history of Hacienda Riquelme told by aerial photos and The History of Hacienda Riquelme in Cartomur we saw how the geographic information system Cartomur can give us much information about the evolution of a site over the years.

Google Earth also offers this kind of information. To access it you have to press the button Display historical pictures in the toolbar of the program. The images of the area of Hacienda Riquelme and Sucina are available for the following dates:

Europesadilla / Euro-nightmare

In July 2012 we published the post Apecracy about a book and video by Aleix Saló on the Spanish politics situation.

On past April 2013, this author presented a new book and video entitled Euro-nightmare. Someone has eaten the middle class
