El Casón de Riquelme and its annexes: a protected heritage

This summer, many property owners, especially Spanish ones, were unpleasantly surprised by renovations to the Casón architectural complex located next to Calle Atlántico. Part of the facade, originally white, is now glossy black, in addition to other significant alterations. Many of us consider the result aesthetically unfortunate, but there are more problems.

As can be seen on the Murcia City Council's geoviewer, the Casón de Riquelme and its adjoining buildings are protected as listed properties of cultural significance. They have been assigned Structural Protection (Grade 2), which limits any alterations to the complex, requiring the preservation of its original facades and volume.

In the Region of Murcia, the protection of a listed property of cultural significance is a shared responsibility between the Regional Government (CARM) and the City Council, in this case, the City of Murcia. The Regional Government establishes the legal framework for heritage protection, and the City Council is responsible for ensuring compliance. This is achieved through the General Urban Development Plan (PGOM) and building permits.

If you believe an infraction may be occurring, or simply want to know if and how the work was authorized, what reports were used, and whether the work carried out complies with the project plans and protection regulations, you can file a complaint. We know that several owners have already done so.

We wonder how the managers of the resort's General Community will now be able to oppose arbitrary modifications to the apartments by their owners.

And one last point. According to Article 20 of the Horizontal Property Law (LPH), it is the administrator's responsibility to ensure the proper functioning of the building, its facilities and services, and to issue the appropriate warnings and notices to the owners for this purpose.

La reforma realizada en el local no respeta en absoluto la estética ni la coherencia arquitectónica del edificio.

Resulta difícl de entender que la administración haya autorizado una modificación de estas características, sentando un precedente preocupante respecto al cumplimiento de las normas comunitarias. Si se permiten este tipo de alteraciones en elementos visibles y zonas comunes, como el revestimiento de la fachada o la modificación del jardín para crear accesos privados, se entiende que el resto de propietarios quedamos legitimados para realizar modificaciones equivalentes en nuestras viviendas.

Habrá que ver si se revisa esta actuación o si a partir de ahora las normas de la comunidad pasan a ser totalmente opcionales para todos.
